Terms of website use

Effective from:

1. Scope and acceptance

These Terms set out the rules for using the website operated at www.muzel.pl (the “Site”) and the electronically supplied services described in clause 3.
These Terms are provided free of charge in a form enabling them to be read, downloaded, stored and reproduced. Use of the Site means acceptance of these Terms.
These Terms do not govern sales of Goods. Orders, payment, delivery, returns, complaints and formation of a sales Contract are governed by MUZEL’s separate Terms & Conditions of Sale. Where there is a conflict relating to a purchase of Goods, the Terms & Conditions of Sale prevail.

2. Service provider and contact

The service provider and operator of the Site is MUZEL Sp. z o.o., ul. Skandynawska 5, Modła Królewska, 62-571 Stare Miasto, Poland, KRS 0000573546, NIP/VAT PL 6652999493, REGON 362405877.

3. Services supplied electronically

MUZEL provides, free of charge, in particular: browsing of Site content, use of Store functions, the basket and the Order process (checkout), contact forms and – where available – creation and operation of an Account.
The agreement for the service of browsing the Site is concluded when use of the Site begins and ends when the User leaves it. An Account agreement ends when the User deletes the Account or requests deletion at shop@muzel.pl, without prejudice to data that MUZEL must retain by law or to defend claims.
In connection with an Order, MUZEL may send transactional communications, including an Order Acknowledgement and information about payment, dispatch, invoice, return or complaint. These communications are not a newsletter or marketing communications. Sales-related services are governed by the Terms & Conditions of Sale, and personal-data processing is governed by the Privacy Policy.

4. Technical requirements and access

Use of the Site requires at least: an internet-enabled device, a current web browser and, for an Account or Order, an active email address. Some functions may require JavaScript and cookies necessary for their operation to be enabled.
The User is responsible for arranging internet access and keeping their device secure. MUZEL may from time to time restrict access to the Site for technical, security, maintenance or update reasons.

5. Account and security

Where the Site allows an Account to be created, the User must provide true, current and complete data and update them where necessary. Login credentials must be kept confidential and must not be shared with third parties.
Any suspected unauthorised use of an Account must be reported to MUZEL without undue delay. MUZEL may temporarily block or restrict an Account where justified by security protection, suspected misuse or a material breach of these Terms; where reasonably possible, MUZEL will inform the User.

6. Information on the Site and Orders

Site content, including product descriptions and technical information, is general and informational. Binding terms for Goods, including formation of a Contract, prices, VAT, payment, delivery, returns and complaints, are set out in the Terms & Conditions of Sale, the relevant product description, checkout, Order Acknowledgement, Despatch Confirmation, quotation or agreed technical documentation – as applicable.
Information on the Site does not replace an individual assessment of a Good’s suitability for a particular filling process, product or use. The User or Buyer should verify such suitability in accordance with the Terms & Conditions of Sale and the documentation for the relevant Good.
Placing an Order and formation of a sales Contract take place under the Terms & Conditions of Sale; use of the Site by itself does not create a sales Contract.

7. Intellectual property and linking

Site content, including trademarks, names, photographs, graphics, designs, drawings, technical documentation and Site-layout elements, is protected by law and belongs to MUZEL, its licensors or other authorised parties.
The Site may be displayed and extracts may be downloaded or printed only for personal or internal business reference. Copying, distribution, modification, publication or commercial use requires prior written consent unless mandatory law provides otherwise.
You may link to the home page in a fair and lawful way that does not suggest any association with, approval by or endorsement from MUZEL. You must not frame the Site on another website. MUZEL may withdraw linking permission.

8. Prohibited use

The User must not use the Site in a manner contrary to law, these Terms or third-party rights, in particular:
• introduce malicious software, attempt unauthorised access, bypass security measures or disrupt operation of the Site;
• automatically download, copy or obtain data from the Site without authorisation, including through bots, crawlers or scraping;
• use contact data or Site content for unauthorised marketing, impersonation or infringement of intellectual-property rights;
• submit unlawful or offensive content, content infringing third-party rights or content that may endanger Site security.

9. Availability, changes and liability

MUZEL makes reasonable efforts to keep Site content current and the Site functioning properly, but does not guarantee uninterrupted availability or that every item of information will be error-free or always up to date.
MUZEL may at any time update, change, suspend or withdraw all or part of the Site, in particular for technical, security, legal or business reasons. This does not affect rights and obligations under sales Contracts already concluded.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law or Consumer rights. Liability rules concerning Goods are set out in the Terms & Conditions of Sale.

10. Privacy, cookies and external links

The Privacy Policy of MUZEL sets out the rules for personal-data processing, including purposes, lawful bases, recipients, retention periods and data-subject rights.
The separate Cookie Policy sets out rules for cookies and similar technologies. The cookie banner enables the User to reject cookies other than necessary cookies by selecting “Reject non-essential”. Use of the Site in itself does not constitute consent to cookies for which consent is required.
The Site may contain links to third-party websites or resources. MUZEL is not responsible for their content, availability or privacy practices; use of them is subject to the relevant parties’ terms and policies.

11. Complaints about electronic services

Complaints about use of the Site, an Account or electronically supplied services may be sent to shop@muzel.pl. A complaint should include the User’s contact details, a description of the issue and, where possible, the date and circumstances in which it occurred.
MUZEL will examine the complaint without undue delay, normally within 14 days of receipt. This clause does not limit statutory Consumer rights concerning Goods; complaints about Goods are governed by the Terms & Conditions of Sale.

12. Governing law, changes and contact

These Terms are governed by Polish law. For a Consumer, the choice of Polish law does not deprive the Consumer of protection afforded by mandatory provisions of the law of the country of the Consumer’s habitual residence. Court jurisdiction is determined in accordance with mandatory law.
MUZEL may update these Terms, in particular where law, Site functions, technology or security requirements change. The current version will be published on the Site with an effective date. Changes do not affect sales Contracts concluded before they enter into force.
