Shipping & delivery policy

Introduction
This Shipping & Delivery Policy sets out rules for dispatch and delivery of Goods sold by MUZEL through www.muzel.pl or under a Quotation. It supplements MUZEL’s Terms & Conditions of Sale and should be read together with the Terms of Website Use and Privacy Policy.
Where there is a conflict relating to formation of a Contract, Price, VAT, payment, risk, returns, complaints or liability, the Terms & Conditions of Sale prevail.

1. Delivery area
Delivery is available only to European Union countries available at checkout or stated in a Quotation.
MUZEL does not deliver outside the European Union under sales covered by this Policy.
Availability of delivery to a particular location depends on carrier availability, the shipment’s technical requirements and the information provided by the Buyer.
2. Price, VAT and delivery cost
For a Buyer who is not a Consumer, the Price shown on the Site or in a Quotation may be a net price and includes delivery cost and other costs connected with fulfilment of the Order; VAT is added separately at the applicable rate.
Before a Consumer is bound by an Order, MUZEL clearly states the total price including VAT and all mandatory charges. Where delivery cost is stated separately, it is included in the Total Amount Payable before the Order is placed.
For an individual or non-standard Order, delivery-organisation details, including timing, access or unloading requirements, may be stated in the Quotation. The Price and costs apply in accordance with the terms shown to the Buyer before the Buyer is bound by the Order.
3. Preparation and dispatch timing
An estimated dispatch date is shown on the Site, in the Order Acknowledgement or in a Quotation, depending on how the Order is placed. Dates are estimates unless MUZEL expressly agrees otherwise with the Buyer.
After Goods are handed to the carrier, MUZEL may provide tracking information or an estimated delivery date where such information is available.
If MUZEL anticipates a material delay, it will notify the Buyer without undue delay. This clause does not limit mandatory Consumer rights.
Unless a different delivery time is expressly agreed with a Consumer, MUZEL delivers the Goods without undue delay and no later than 30 days after the Contract is formed, subject to mandatory law.
4. Delivery address, access and receipt
The Buyer is responsible for providing a correct and complete delivery address and, where needed, contact details and access instructions.
For deliveries requiring special access, unloading, equipment, personnel or a pre-booked delivery slot, the Buyer must ensure suitable receiving conditions in accordance with information on the Site, the Quotation or the parties’ agreement.
For a Consumer, Goods should be taken into physical possession by the Consumer or a person designated by the Consumer. For other Buyers, receipt may be confirmed by an authorised person at the delivery location.
5. Risk and title
For a Consumer, risk of accidental loss of or damage to Goods passes when the Consumer, or a person designated by the Consumer, takes physical possession of the Goods.
Where the Consumer independently selects a carrier not offered by MUZEL, risk passes when Goods are handed to that carrier.
For a Buyer who is not a Consumer, risk passes on Delivery. Title passes to the Buyer only upon MUZEL’s receipt of cleared payment in full.
6. Failed delivery attempt
If delivery cannot be completed because of an incorrect address, lack of access, unsuitable receiving conditions or other circumstances attributable to the Buyer, MUZEL or the carrier may contact the Buyer to agree the next steps.
Any additional redelivery, storage or return-to-sender costs resulting solely from such circumstances require prior information to the Buyer and are subject to applicable law.
This clause does not limit mandatory Consumer rights.
7. Inspection on delivery and reports
The Buyer should inspect Goods on Delivery. Transport damage or shortages should be reported without undue delay, preferably within 48 hours, with photographs and carrier notes where available.
Quality issues or defects should be reported as soon as reasonably possible, with batch numbers, photographs and a brief description of filling, product and storage conditions. Goods or samples to which the report relates should be retained while the matter is investigated.
Reports concerning delivery, shortages or damage should be sent to shop@muzel.pl. Timeframes and organisational requirements in this Policy do not limit rights arising from mandatory law.
8. Partial shipments and individual arrangements
MUZEL may fulfil an Order in more than one consignment where justified by logistics or Goods availability. Splitting an Order into consignments does not by itself create an additional delivery charge.
Where Goods are custom, made to order or require separate transport arrangements, dispatch and delivery rules may be specified in a Quotation or written agreement between the parties.
Personal collection or transport arranged by the Buyer is possible only with MUZEL’s prior written agreement; risk and receipt rules are then governed by the Terms & Conditions of Sale and that agreement.
9. Returns, withdrawal and complaints
A Consumer’s right to withdraw from a distance Contract, returns, complaints and rules concerning Goods that lack conformity with the Contract are set out in MUZEL’s Terms & Conditions of Sale.
Any requirement for prior contact or an RMA number serves only to facilitate logistics and does not limit a Consumer’s statutory right to withdraw from the Contract or make a complaint.
This Policy does not change rules on returns of custom-made Goods or MUZEL’s liability set out in the Terms & Conditions of Sale and mandatory law.
10. Personal data, changes and contact
To carry out delivery, MUZEL processes data necessary to prepare and deliver the shipment, including recipient details, address, contact details and Order information. Data may be transferred to carriers and logistics partners only to the extent necessary for delivery.
The Privacy Policy of MUZEL sets out the purposes, lawful bases, recipients, retention periods and data-subject rights. For personal-data protection matters: a.severyn@muzel.eu.
MUZEL may update this Policy. Changes do not affect delivery terms agreed for Orders accepted before the changes take effect. Questions about delivery should be sent to shop@muzel.pl.
